Terms & Conditions and Acceptable Use Policy

Welcome to Cybercloud Web Hosting (“Service”). These Terms & Conditions and Acceptable Use Policy govern the use of our web hosting and infrastructure solutions provided by Cybercloud (“Company,” “we,” “us,” or “our”).
By subscribing to, accessing, or using our Service, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you may not use the Service.
1. Service Overview
Cybercloud Web Hosting provides a complete suite of hosting and domain infrastructure services, including:
- Domain name registration and management
- Shared, reseller, and cloud hosting with cPanel and Plesk control panels
- WordPress hosting
- Virtual Private Servers (VPS) with scalable CPU, RAM, and SSD Storage
- SSL Certificates and security add-ons
- 100% Datacenter & 99.9% Network Uptime SLA
- Local hosting infrastructure (NDPR and CBN compliant)
- VPN Access with Role-Based Access Control (RBAC) for applicable plans
- Backup and Disaster Recovery options
- Optional 24/7 Monitoring & Support
- Quick setup, easy scaling, and managed service options
Our hosting services support mission-critical applications across finance, education, FMCG, enterprise, and public sector organizations.
2. Customer Responsibilities
You are responsible for:
- All content, applications, and data hosted under your account or server.
- Protecting your access credentials (cPanel, Plesk, VPN, RBAC, etc. where applicable).
- Ensuring compliance with all applicable laws and industry regulations.
- Maintaining independent backups beyond those optionally provided by the Company.
3. Acceptable Use Policy (AUP)
You agree not to use the Service for:
3.1 Unlawful Content & Activities
- Hosting illegal, obscene, defamatory, extremist, or offensive material.
- Fraud, money laundering, unlicensed financial services, or illegal gambling.
- Infringement of third-party intellectual property rights.
3.2 Security & Abuse
- Launching or participating in DoS/DDoS attacks.
- Distributing malware, ransomware, or harmful code.
- Attempting unauthorized access to networks or data.
3.3 Spam & Communications
- Sending unsolicited bulk messages (spam).
- Running open relays, open proxies, or similar systems.
3.4 Restricted Use
- Cryptocurrency mining, arms-related activities, or terrorism.
- Hosting pornography, sexually exploitative, or extremist content.
4. Resource Usage
- Customers must not consume excessive CPU, RAM, storage, or bandwidth that negatively affects infrastructure or other customers.
- The Company may impose reasonable limits or take corrective actions to maintain system stability.
5. Service Availability & SLA
- 100% uptime for datacenter and 99.9% uptime for network connectivity.
- SLA excludes downtime due to maintenance, misuse, third-party applications, or force majeure.
- Remedy: service credits only. No damages or refunds will be provided.
6. Fees & Payment
- All fees are payable in advance and are non-refundable unless otherwise stated.
- Late or non-payment may result in service suspension or termination.
7. Data Privacy & Security
- The Company will implement reasonable measures to safeguard Customer data.
- Absolute security cannot be guaranteed.
- Customers remain solely responsible for compliance with NDPR, CBN, and any sector-specific requirements.
8. Intellectual Property
- The Company retains ownership of all infrastructure, software, and technology used in providing the Service.
- The Customer retains ownership of all content and data hosted.
9. Limitation of Liability
- The Company shall not be liable for indirect, incidental, or consequential damages (including lost profits, data, or business).
- Aggregate liability is limited to fees paid by the Customer in the three (3) months preceding the claim.
10. Indemnity
Customers agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from their use of the Service, including regulatory non-compliance or unlawful content.
11. Suspension & Termination
- The Company may suspend or terminate services immediately for violations of this Agreement.
- Data may be permanently deleted upon termination.
12. Governing Law & Dispute Resolution
- This Agreement shall be governed by the laws of the Federal Republic of Nigeria.
- Disputes will be resolved amicably or, failing that, by arbitration in Lagos under the Arbitration and Conciliation Act.
13. Modification of Terms
- The Company reserves the right to amend this Agreement at any time.
- Continued use of the Service constitutes acceptance of updated terms.
14. Entire Agreement
This Agreement represents the full understanding between the Company and the Customer regarding web hosting and infrastructure services and supersedes all prior agreements.
15. Acceptance
By checking the box and/or clicking “I have read and agree to the Terms of Service” during the Review and Checkout process, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including both the Terms & Conditions and the Acceptable Use Policy (AUP).
